Terms and Conditions

1. Scope
For all business relationships between The Shop and the purchaser, only our General Terms and Conditions in their current version at the time of ordering apply.

2. Conclusion of Contract
Our offers are non-binding and represent an invitation to order goods in our online shop. By clicking the "Order with obligation to pay" button, you submit a binding offer to purchase within the meaning of § 145 BGB. Upon receipt of the purchase offer, you will receive an automatically generated email confirming that we have received your order (receipt confirmation). This receipt confirmation does not yet constitute acceptance of your purchase offer. A contract is only concluded when we expressly accept the purchase offer (order confirmation) or when we send the goods to you without prior express acceptance.

3. Delivery and Shipping Costs
Unless otherwise agreed, delivery is free of charge within Germany to the delivery address specified by the purchaser. Information about the delivery time is non-binding and up to date in the shipping conditions.

Shipping costs for products without age verification are €2.99. For items with age verification, it is €4.99. Delivery within 1-3 working days - with tracking. Shipping is free for orders over €75.00. This applies to shipping within Germany. If you reside in Austria, shipping costs €5.99. In Switzerland, it is €7.99. The same applies to all other EU countries. The delivery time abroad is 2-5 working days - with tracking. Shipping time depends on the delivery traffic of the DHL Group.

4. Right of Withdrawal
In the event that you are a consumer within the meaning of § 13 BGB, you have a right of withdrawal in accordance with the following provisions.

5. Payment Terms
Payment for the goods is made either by advance payment or PayPal. Bioflavour & Food GmbH reserves the right to exclude certain payment methods in individual cases. Invoicing is done without exception, including the applicable value-added tax. Payment by sending cash or checks is unfortunately not possible. We exclude liability in case of loss.

Payment by advance payment: Prepayment. Shipping takes place after receipt of payment.

6. Retention of Title
Until full payment, the goods remain the property of The Shop. If you are an entrepreneur within the meaning of § 14 BGB, the following additional provisions apply.

7. Warranty and Liability
If delivered items have obvious material or manufacturing defects, including transport damage, please report such defects immediately to Bioflavour & Food GmbH. For these and all other defects of the purchased item occurring during the statutory warranty period, the purchaser's statutory rights apply in accordance with § 437 BGB.

8. Delivery Reservation
The sale of the offered goods is only to persons of legal age. We reserves the right to reject incoming orders for economic reasons, even without justification. We reserve the right not to provide the promised service in case of unavailability. At the same time, we undertake to inform you immediately about the unavailability and to refund any consideration received immediately. Errors and changes are expressly reserved. Please understand that delivery to German customs-free areas is not possible.

9. Data Protection
The personal data necessary for processing the contract is provided by the purchaser. The personal data necessary for the execution of the transaction is stored and, if necessary, passed on to third parties within the framework of the proper handling of the order processing. The handling of the data is in accordance with the provisions of the Federal Data Protection Act and the Telemedia Data Protection Act. All personal data is treated confidentially. We have particularly high security standards and undertake to protect your data from any unauthorized access.

10. Alternative Dispute Resolution
The European Commission has provided a platform for out-of-court dispute resolution. This gives consumers the opportunity to resolve disputes related to their online order without involving a court. 11. Final Provisions (Severability Clause)
If one or more provisions of these terms and conditions are or become invalid, this shall not affect the validity of the remaining provisions. German law applies exclusively to contracts between us and you, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG, "UN Sales Law"). Mandatory provisions of the country in which you usually reside remain unaffected by the choice of law. If you are a merchant, a legal entity under public law, or a special fund under public law, our place of business is the place of jurisdiction for all disputes arising from or in connection with contracts between us and you.

12. Copyright
Copyright by Us. The pages of our online shop are protected by copyright. Imitation, even in part, is only permitted with the permissionby us. The illustrations are protected by § 72 of the Copyright Act.

13. Information for "Not Picked Up" or "Not Delivered"
In the event of non-delivery/pickup due to: no access to the building, return at the request of the recipient, no sign on the doorbell, recipient possibly moved, package not picked up at the branch, etc., a return fee of €6.00 including VAT is charged by DHL, which the customer must bear.

Returns are automatically canceled upon receipt by us, and the refund is initiated within 10 working days, minus the above-mentioned return fee.
